Welcome to Cloud Cases.

These Terms of Service (“Terms”) govern your access to and use of the Cloud Cases website at https://buycloudcases.com, our products, services, memberships, and any purchases made through us.

Cloud Cases is a brand operated by ECOMMERCECOLEMAN LLC, a Nebraska limited liability company (“Cloud Cases,” “we,” “us,” or “our”).

By accessing our website, placing an order, creating an account, or enrolling in a membership, you agree to these Terms and any policies referenced within them.

If you do not agree to these Terms, you should not use our website or purchase our products or services.

1. ELIGIBILITY

You must be at least the age of majority in your jurisdiction, or have the permission of a parent or legal guardian, to use this website or make a purchase.

By placing an order, you confirm that the information you provide is accurate and that you are legally authorized to use the payment method provided.

2. ONLINE STORE TERMS

You may not use our products, website, or services for any unlawful or unauthorized purpose.

You must not transmit viruses, malicious code, automated scraping tools, or other technology intended to interfere with the operation or security of our website.

We reserve the right to refuse service, restrict access, cancel orders, or terminate accounts where we reasonably believe there has been fraudulent, abusive, unlawful, or otherwise improper activity.

We make reasonable efforts to display our products, colors, finishes, dimensions, specifications, and other product information accurately.

However, colors and appearance may vary depending on your device, screen settings, photography, lighting, production batches, or manufacturing processes.

Minor differences that do not materially affect the function of a product will not necessarily constitute a defect.

You are responsible for selecting the correct phone model, size, color, or product variation before completing your purchase.

Compatibility information is provided in good faith. If you are unsure whether a product is compatible with your device, please contact us before ordering.

4. AVAILABILITY

Products may be available in limited quantities.

We may modify, discontinue, replace, or restrict the sale of any product at any time without prior notice.

Adding an item to your cart does not reserve inventory.

5. ORDERS

Submitting an order constitutes an offer to purchase from us.

We reserve the right to accept or decline any order.

We may cancel or limit an order where we reasonably believe:

incorrect pricing or product information was displayed;
a product is unavailable;
an order appears fraudulent;
a promotion has been abused;
unusually large quantities are being purchased for resale;
payment cannot be successfully processed; or
accepting the order would violate applicable law.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled portion of the order.

6. PRICING

Prices displayed on our website may change at any time.

Unless otherwise stated, prices are displayed in the currency shown at checkout.

We reserve the right to correct pricing, promotional, typographical, or other errors, including after an order has been submitted.

Where applicable, taxes, duties, customs charges, shipping fees, or other charges may be added at checkout or become payable upon importation.

Customers are responsible for customs duties, import taxes, or similar government charges unless we expressly state otherwise.

7. PAYMENT

You agree to provide current, complete, and accurate billing and payment information.

By submitting payment details, you confirm that you are authorized to use the selected payment method.

Payments may be processed by third-party payment providers.

We do not guarantee that any particular payment method will always be available.

You authorize us and our payment providers to charge your selected payment method for all amounts shown and agreed to during checkout, including applicable taxes, shipping charges, add-ons, and recurring membership fees where applicable.

8. CLOUD CASES VIP MEMBERSHIP

Cloud Cases may offer optional recurring membership programs, including the Cloud Cases VIP Membership.

Where you enroll in a recurring membership, the price, billing frequency, membership benefits, and any introductory period will be disclosed to you before you complete your purchase.

Unless a different amount or billing frequency is clearly displayed when you enroll, the Cloud Cases VIP Membership is billed at $29.99 USD every 30 days.

By enrolling, you expressly authorize us to charge your selected payment method automatically at each billing interval until the membership is canceled.

Automatic Renewal

Your membership automatically renews at the end of each billing period unless you cancel it before your next scheduled billing date.

You do not need to make another purchase or manually approve each recurring payment.

Membership Benefits

Benefits may include, depending on the offer available when you join:

member-only pricing;
exclusive products, colors, or releases;
early access to product launches or restocks;
shipping benefits;
promotional offers;
member rewards or credits; and
other benefits displayed on the membership offer.

Specific benefits may vary over time.

We may add, remove, or modify membership benefits where reasonably necessary. Material changes will be communicated where required by applicable law.

Cancellation

You may cancel your membership at any time through any cancellation method made available by us, including through your customer account, designated cancellation page, or by contacting customer support at support@buycloudcases.com.

Cancellation prevents future renewal charges but does not ordinarily reverse a membership charge that has already been processed, except where required by applicable law or provided for under our Refund or Subscription Policy.

Your membership benefits may remain active until the end of the billing period you have already paid for.

Failed Payments

If a recurring payment fails, we or our payment provider may attempt to process the payment again.

Membership benefits may be suspended or terminated if payment cannot be collected.

Membership Pricing Changes

We may change membership pricing from time to time.

Where required by law, we will provide advance notice before a new membership price applies to a future renewal.

Additional membership rules may be contained in our Subscription Policy, which forms part of these Terms.

9. PROMOTIONS, DISCOUNTS AND BUNDLES

We may offer discounts, promotional pricing, free gifts, bundles, buy-one-get-one offers, VIP pricing, discount codes, or other promotions.

Promotions may be subject to additional conditions.

Unless expressly stated otherwise:

promotions cannot be combined;
discounts have no cash value;
promotions may be limited to one per person, household, account, payment method, or address;
promotional products may be subject to availability; and
promotions may be modified or withdrawn at any time before an eligible order is placed.

We may cancel orders where we reasonably determine that a promotion has been exploited, manipulated, or used contrary to its intended terms.

10. SHIPPING

Shipping estimates displayed on our website are estimates rather than guaranteed delivery dates unless expressly stated otherwise.

Delivery times may be affected by customs processing, carriers, weather, public holidays, high order volumes, incorrect addresses, or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address.

11. SHIPPING PROTECTION

Where shipping protection or a similar optional service is offered during checkout, the price and coverage applicable to that service will be displayed before purchase.

Shipping protection does not affect any mandatory consumer rights you may have under applicable law.

Any eligibility requirements, exclusions, claim procedures, or limitations associated with shipping protection will be described in the applicable policy or offer.

12. RETURNS, REFUNDS AND EXCHANGES

Returns, refunds, exchanges, damaged products, incorrect products, and related claims are governed by our Refund Policy, which forms part of these Terms.

Nothing in these Terms limits any statutory consumer rights that cannot lawfully be excluded.

13. ORDER ISSUES

If you believe your product is damaged, defective, incorrect, or missing, you should contact us as soon as reasonably possible at support@buycloudcases.com with your order information and any requested photographs or supporting information.

We may require reasonable evidence before approving a replacement, refund, or other remedy.

14. CHARGEBACKS AND PAYMENT DISPUTES

If you believe a charge has been made incorrectly, we encourage you to contact us first so that we can investigate and attempt to resolve the issue.

Nothing in these Terms prevents you from exercising any lawful rights available through your bank, card issuer, payment provider, or applicable consumer-protection law.

We reserve the right to provide order records, delivery information, account activity, membership disclosures, cancellation records, communications, and other relevant evidence to payment providers when responding to payment disputes.

Fraudulent or abusive payment disputes may result in restriction or termination of your account.

15. ACCOUNTS

If you create an account, you are responsible for maintaining the confidentiality of your login information.

You are responsible for activity conducted through your account unless caused by circumstances outside your reasonable control.

You should contact us promptly if you believe your account has been accessed without permission.

16. CUSTOMER REVIEWS AND CONTENT

If you submit a review, photograph, video, testimonial, comment, suggestion, or other content to us, you confirm that you have the right to submit that content.

Purchasing a product does not transfer ownership of any intellectual-property rights associated with that product or our brand.

to infringe intellectual-property rights;
to harass or harm others;

to distribute malicious software;

This may include loss of profits, revenue, data, opportunity, or goodwill where such losses may lawfully be excluded.

Where our liability cannot be excluded but may legally be limited, our aggregate liability relating to a particular order will not exceed the amount you paid to us for that order.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer law.

23. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Cloud Cases, ECOMMERCECOLEMAN LLC, and their affiliates, officers, employees, agents, and service providers against claims, liabilities, losses, or reasonable expenses resulting from your unlawful misuse of our website, violation of these Terms, or infringement of another person's rights.

24. FORCE MAJEURE

We will not be liable for delays or failures caused by circumstances reasonably outside our control, including natural disasters, severe weather, war, civil unrest, government restrictions, labor disputes, telecommunications failures, carrier disruption, supply-chain interruption, pandemics, or failures of third-party infrastructure.

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will continue in effect.

29. NO WAIVER

If we do not immediately enforce a provision of these Terms, that does not mean we have waived our right to enforce it later.

30. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, Subscription Policy, and any other policies expressly incorporated into them, constitute the agreement between you and us relating to your use of our website and services.

31. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The latest version will be posted on this page together with the date it was last updated.

Changes will apply from the date they are published unless applicable law requires additional notice.

Material changes affecting an existing recurring membership will be communicated where required by law.
